End User License Agreement

Please read this agreement carefully before installing or using FlexiLink (the "Software"). By installing, copying or otherwise using the Software, you agree to be bound by this agreement. If you do not agree, do not install or use the Software.

1. License.

Subject to this agreement, the developer of FlexiLink ("we", "us") grants you a non-exclusive, non-transferable license to install and use the Software as follows. (a) Evaluation: you may use the Software free of charge for a 30-day evaluation period. (b) Paid license: each license you purchase permits use of the Software on one (1) computer, and a pack of licenses permits use on as many computers as the number of licenses it contains. A license is tied to the computer on which it is activated. You may move a license to another computer, after which it stops working on the previous one; each license may be moved once every 90 days, and we may allow additional moves at our discretion. Reinstalling or resetting Windows may cause a computer to be treated as a new one. For example, using the Software on a home computer and on a work computer requires two licenses.

2. Restrictions.

You may not: (a) sell, rent, lease, sublicense or otherwise distribute the Software except as expressly permitted by us; (b) reverse engineer, decompile or disassemble the Software, except to the extent applicable law expressly permits it despite this limitation; (c) remove or alter any copyright or other proprietary notices in the Software.

3. Ownership.

The Software is licensed, not sold. We and our licensors retain all right, title and interest in the Software, including all intellectual property rights. Any rights not expressly granted in this agreement are reserved.

4. Third-party components.

The Software includes open-source components licensed under their own terms, listed with their licenses in the ThirdPartyLicenses.txt file installed with the Software. Those terms govern your use of those components. The Software also relies on the Microsoft Windows App SDK Runtime, which is licensed to you by Microsoft under its own terms.

5. Updates, activation and data.

To tell you about new versions, the Software periodically contacts flexilink.app (once a day when its tray icon is enabled, and whenever you choose "Check for updates"). The Software also contacts flexilink.app to activate and verify a license. These requests include an installation identifier tied to your Windows installation, which we use to offer updates and to check your license. They do not include your browsing history, the links you open, your rules or any other personal content; as with any internet request, your IP address is visible to the server. You can turn off the automatic daily check in the Software's Settings. Updates are downloaded and installed only when you choose to.

6. No warranty.

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED.

7. Limitation of liability.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS OR BUSINESS, ARISING OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THIS AGREEMENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Some jurisdictions do not allow these exclusions, so they may not apply to you.

8. Termination.

This agreement is effective until terminated. It terminates automatically if you fail to comply with any of its terms. Upon termination you must stop using the Software and uninstall it.

9. Entire agreement.

This agreement is the entire agreement between you and us regarding the Software. If any provision is held unenforceable, the remaining provisions remain in full force and effect.
